 Everlight sues Bridgelux over infringement

Everlight Electronics (2393) has announced yesterday (13th) that in June they have filed a patent-infringement lawsuit in the United States District Court of California over the products manufactured and sold by Bridgelux which have infringed the patented technology US6335548 and US7253448 of Everlight, including the infringing products of the 2835 series.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                            

Everlight demanded the court to apply injunction against the products of Bridgelux that infringed their rights, including the prohibition of sale, manufacture and import-export as well as the compensation for the damages. The patent numbers US6335548 and US7253448 are basic patent of LED structure, which broadly used in 2835, 5630, 3030, 3535, 5050 and COB products. Everlight has already well arranged the strategies for their patents in the United States, Korea, Japan and Europe, and will actively advocate their rights.

Meanwhile, Everlight has filed a patent-infringement lawsuit in the District Court of Tokyo in 25th of this April over the infringement against the patent of Everlight No. JP3989794 committed by Nichia , Citizen, and Daiko electric. Everlight demanded the court to apply injunction against the whole series of COB infringing products of the defendants, including prohibition of sale, manufacture and import-export, destruction of the inventory, as well as compensation for the damages, and will continuously take legal action against the other infringing companies.

In response to what Nichia has announced in 12th July concerning the litigation with Wofi Leuchten, the subsidiary of Everlight in Germany, Everlight specified that the litigation for the invalidity of the European patent number EP 0936682 is still in judicio in Federal Patent Court of Germany. In view of the invalidity judgment determined in the United States and in Taiwan for this patent family, Everlight believes that the European patent will be also judged invalid.

Everlight emphasizes that since always they persist in respecting the intellectual property rights and trying their best to protect the rights and interests of their clients and shareholders.
